sorry mate but you were speeding.. fact... not a great deal you can do about it. man up take the ponts and move on slightly wiser.
fact is you were over 20% over the limit.

thing is on a counrty lane and a cyclist appears from nowhere.. that 8mph in something the size of a range rover could be all the difference it needs.

stop being such a girl and crying about it. if you had ACC then i can see your point.

If you haven't already don't send the NIP back until 2 days before it's actually due, there is then a slim chance it might time out if they're busy being tax collectors. MY2011 HSE Santorini/Ivory/Piano Black/Privacy Glass/TV .Sadly gone.

It achieves the same as it does with tickets from private parking vultures if they dont put a ticket on you car and pursue you by post, gets timed out by their own policy and procedure manual. 08 2.7 RRS "S"

Ady,
Yes ,basically I can't remember how many days it is will have a look on Pepipoo to check when I've got a minute but if you delay sending the NIP back until 2 days before it's due it gives them less time to respond and if they have been particulary busy then there is a slim chance they might not get your summons out on time and if they do you can legally tell them you're opting out of their new road tax scheme Very Happy
Andy,
You don't EVER have to do anything at all with private parking vultures just completely igore everything they ever send and although a little scary when the solicitors and bailiffs letters arrive they eventually give up and leave you alone and yes I have successfully done this after my daughter got caught in Chez Vegas.

Just checked:
NIP has to be received within 14 days or it has timed out unless your were actually stopped and given a verbal NIP.
NIP has to be returned within 28 days so post on 25th day.
Summons has to be received within 6 months of date of actual offence or has timed out.

So keep all correspondence including any envelopes and your proof of posting. MY2011 HSE Santorini/Ivory/Piano Black/Privacy Glass/TV .Sadly gone.

There's a very high chance you can avoid having to take the three points, it may cost you a bit of cash to do so though, if you've got a clean licence I'd take them, if you already have some points I'd find someone who has experience to represent you and go to court.

They have to issue you with a nip within 14 days of the offence, and have to have you in court within 6 months of the offence, you could waste enough time to go past their 6 month time limit.

They will send someone to your home to try to force you to disclose the drivers name, if you fail to do so they may charge you under section 172(failing to disclose drivers identity).

It's a fairly long process to carry out but has been proven to work, good luck.

its always worth asking for the calibration certificate..............so many ask for them now they are nearly always on top of them, but worth a try, you inconvenience them at least.

They really do p Censored s me off, fair enough book boy racers tearing about dangerously, but come on......a few mph over on a clear road with no one about, not hurting anybody.

It's clearly not about speeding it's just another way of soaking the motorist as an easy way of raising revenue to pay for the great unwashed to stop at home smoking pot and watching day time television.
If it was actually about speeding they would use deterrence, how many police do you see on the motorway now?
If everyone pleaded not guilty to the ridiculous charges and went to court they would soon pack it in,why make it easy for them? MY2011 HSE Santorini/Ivory/Piano Black/Privacy Glass/TV .Sadly gone.

it is really about the speeding isnt it. the dude broke the law and got caught. easy mistake to make i know but neverthe less its done. take ur medicine and move on easy.

i went to totb on sunday and the a64 was rammed with police as is the m62 most days of the week. i tavel up the m6 to glasgow a fair bit and its nailed on i will se a few police cars. i speed... of course i do. everyone does but if i get caught doing it its my own stupid fault. im not gonna sit about and blame my cruise control or anything. yeah 38 in a 30 is a bit harsh and a warning would probably have done the job.

in fact tho its no better than 90 in a 70 percentage wise.

would everyone have the same opinion if there had have been a bump. probably not.

unless these points are going to cause you to lose your lisence i dont get your arguement.

sorry .. just my opinion

martin
