Dented my door and denies it - way forward?

As I was sat in my car, correctly parked in a car park, the family next to me returned to their car and crunched their car door into the side of mine. It now has a crease/dent. I asked for their details, (amidst strong denials and that if I were that precious about a car then i should not park in a car park....) (They were in 2002 clio)

I called my insurance company this morning and they tell me that if there are no independent witnesses, and if the family deny the damage (which is likely going by yesterday's reaction) then there is nothing I can do.

Is this right. Seems very unfair?

1. I can get repaired under my insurance and they will approach other party and if they deny then I have to pay.
2. Or I can approach other party's insurance company, but again if they deny then no way forward.

Don't get me wrong, accidents happen and I'd be the first to take a view and go to Dentmaster and sort it myself, it was just the unbeleivable couldn't care less attitude of the family that gets my goat.

Any thoughts welcome.

i presume they gave you their details, if not IIRC its an offence which you can ask PC Plod to obtain them

Problem is as you say its all down to proof, wether you go through your insurance or theirs, it will increase your insurance risk and possible insurance increase

I have had dents removed for about £50, less hassle than running around after insurance etc

Fact is some people don't care about their car, and they definatly don't care about other peoples cars either

This happened to me twice badly when I had my MG Tf - First time no evidence so paid myself. Second time I was near CCTV and had evidence so they paid up Very Happy

With privacy glass it has even happened when in my car and people still deny it Shocked

I hate this when it happeneds!!!
That's why i allways park at the lowest/highest level of the car park at an stragistic spot.

You should have made immidiately a picture of the car with the door open touching your car.
This would have proven the impact made by their car, as it is a perfect fit.
At the same time their car licence plate will be in the picture.

In Holland all car insurence companies have a fund outof which they pay damages like this.
The only thing you have to do, is go to the police to make a report of the damage.

No such deal in the U.K?

My opinion is that you should report to police as them refusing to give information. Then in six months time (the duration the police have to investigate) they will do something about it. Now from experience, although they may deny it to you and an insurance company, the majority suddenly "Buckle" when they receive a plod call. This is what happened when i got hit in my Lotus Elise

Thanks for the input guys. I have reported the incident to his insurance company in the unlikely event he admits it, and also to confirm in a round about way that the guy had insurance Whistle - as that may influence the next phonecall......... 2007 RRS Supercharged, Black & Ivory, 22" Overfinch and MY10 rear lights.

Ah - well isn't that an admission of an incident then ?!? its not like your car leant on his is it - why would you hand over details if no incident occured...

Bad luck sir, i am sorry to here about your incident, that is the trouble being out on the streets, there are so many Skanky no respect first class A*SS HOLES about. I am paranoid about carpark dings and so far have managed to avoid them.

I have side steps fitted and thought these may help stop the dings, I tend to raise the car to offroad height when I have to leave it in a shop carpark, this does prevent other cars front doors touching anything other than the side step however rear doors seem to be the ones that do the damage a due to the wheel arch cutout.

Good luck with the claim.
