Another nail in our so called free country,, Recently there was the Hunting ban, nothing to do with fox's etc, Then followed the ban of vehicles on most green lanes, rupps etc, Now smoking,
As far as i am concerned, nothing to do whether you smoke or not, but someone telling me what i can and can't do, in my own business
Not a problem with non smoking restaurants, pubs etc, etc But let the proprietor's make a choice and let the customer decide !!

Problem i have already is, 2 of my workshop staff smoke, and 3 don't, After 3 days, the 2 that do, have had to smoke outside, with a combined total of almost 6 hours downtime, with no work done, hey ho, good staff, they know the job has to be done !!, But the other 3 are now grumbling that they have done more work than the smokers !!
So what do i do, sack the smokers, ??? surely that discrimination !! Sack the non-smokers and employ all smokers, so the workshop will not need to be smoke free,?? Can not see that working when the little Hitlers come stomping in !! 997 TT, RR TDV8 Vog SE 90 V8 Hybrid

Caught between a rock and a hard place there TJ101. If you make the smokers work instead of a smoke break you'll be done on infringing their human rights, ifyou give the non smokers more time off you'll be left picking up the bill! Glad I'm self employed. 2005 Zambezi TDV6 - Gone but not forgotten

I'm pretty certain that staff are only entitled to an unpaid break if they work a continuous shift of 6 hours or more. Less than that, they're not entitled to stop work. Therefore, as smoking legislation is law, and it's now illegal to smoke indoors at work, it's their problem.., do it in their own time. Not aware that anybody is automatically entiltled to smoke, cant do it in airports or airplanes, so no civil liberties issues there?

It's quite true that empoyers' rights are diminshing in favour of employees. I'm currently paying maternity leave for a person who wont return, but cant fill the job AND got to pay wages to her AND the employee "temporarily" covering her. we only have four smokers out of 14 so the average isn't bad, a new employee asked us this week.
"where do i smoke"

he was told outside

He said "its raining"

so wear a coat.
