But thinking it through proper, its just like me seeing a nice car on here and asking for finance against the reg of the car. I don't own the car but I've got finance on it cus what the companys done is illegal. I really doubt he has a leg to stand on.

Don't worry, chap; have another drink and tune in on Wednesday for the finale? Might get to find out what exactly Eazy signed.

Couple of things,it's not a Jeep that is just confusing things, secondly I may be wrong but I don't think the DVLA has anything to do with the legal position in relation to the sale only who is the RK of the 2 cars not who actually owns what.
As I see it bearing in mind the late hour and gin consumption you don't actually own anything at this point.
He owns your Sport and the finance company owns the Q7.
I get the impression that he won't be panicking but if you leave it untilnTuesday before doing anything you might be.
What is the insurance status of both cars, are they both insured in your name, you might want to consider talking to your insurance company as a possible theft scenario of your Sport?

Sorry chris I can't understand how he owns the sport? He has finance against it yes but iam the registered owner. He also has finance against the q7. He never actually owned the sport. Just the company have done him a favour getting him finance for a private sale without even seeing the car!

For gods sake don't give him anything back until you speak to the finance company, as they now own your RRS AND the Q7 by the sound of it, all you have is 16k
Hope you get it sorted

this is where you now stand mate, all you have is 16k, the q7 is already owned by the finanace company, and by your own admission, the Sport now also has finance on it, if you take it back, the finance company will just take it back of you.
a log book is not a legal document as to owns the car, only that it is registered to you, as the user, its only there so you can tax and insure it, and the dvla know who to send any speeding fines to 07,TDV8,Black, Black Heated leather all round, Rear Entertainment with Headpones & Remote, TV, DVD, Pure Dab Digital Radio, Sidesteps, Adaptive Headlights, sunroof, now working fuel burning heater Smile)))

+1
Your RRS 07 plate I guess would be worth circa £20k ish, so giving you £16k + an Audi Q7 would value his car at £4k! Perhaps he thought that the £16k would include the £13k o/s finance! So then that would be a Q7 plus £3k to swap...

Don't forget electronic payments can be reversed.
A hulalage co that I know, was owed £3k by a customer. They refused to do any further work until acc was cleraed. The 3k was paid by transfer , further work done, money reclaimed.
A CHAPS transfer cannot be reversed.

Keep his 16k, "hide" the Q7 someplace ( Whistle ) and report the RRS as stolen Thumbs Up

Job done

In all reality though, as has been said already, If something sounds too good to be true, it probably is. Sounds like a big scam, and the garage who applied for the finance has been acting illegally (selling a car they dont actually possess), the seller of the Q7 has acted illegally (selling a car with outstanding finance) and who knows whether your 16k payment will be reversed...

Personally, I would either, A)

Have the RRS fixed, and hope he pays off the finance

or, B)

Alert the authorities.

Either way, you still stand the chance of being screwed over and having nothing left. At least if you alert the police, it may help prevent others from suffering the same fate

the log books do not mean you own the car, they mean you are the registered keeper ============

The finance company won't speak to him, only the guy or broker who took out the finance.

Guys it isnt a standard 07 range rover, its a full revere hsr with interior and exterior mods. my car was sale price 28k and he basically gave me his q7 for 12k + 16k which we agreed on.

He called me today saying come to his house on tuesday and he will call black horse infront of me and clear the finance.

If thats the case, before he hangs up ask him if you can have a word with the operator on the phone and ask them if they have anymore financial intrest in the Q7, if the answer is no, then ask them to send a letter to you or your so called mate to clarify this, but don't tell your mate that you want a word with the operator until he has just about finished his conversation with them, just incase he is trying to pull a fast one. Make sure you get the operators full name and telephone number, and finally on this one, trust NOBODY. Shocked personally i would of walked away from this one at the 1st coversation with your neighbour about the deal. I hope you have learnt a lesson with this carry on Wink

Also suggest you obtain a HPI clearance letter from the Finance Co.
So, this chap is going to spend 13k to clear the finance on the Q7...then he gives you the Q7 and 16k, in p/ex for your HST 07 plate RRS with Revere additions which he then puts on finance as well.
He is clearly bonkers!
