Discovery Driver Jailed

This is doing the rounds on LR forums Sad

Quote:
A driving instructor who left two young sisters paralysed after a "road rage" crash in Northamptonshire has been jailed for four-and-a-half years.
Andrew Nay, 39, crashed his Land Rover into the girls' family car as he made a right turn across oncoming traffic on the A509 near Wellingborough.
Katrina Raiba, now six, and her sister Karlina, eight, were left paralysed from the waist down.

This is always a problem with car accidents, you can virtually kill someone this way and not end up with a jail sentence, it was why (in the Police) we spent a lot of extra time investigating fatal road accidents, to ensure no relationship in personal or business life. The sentences have mow been given the option for the Judge to give longer jail sentences, but rarely used, and this is quite a long sentence as before new rules no jail time would be served. With good behaviour etc could still be out in two years. A car is a lethal weapon in many people's hands, but it isn't treated as such when used like that. Crying or Very sad John

Good to see that JLR have dropped him too. When he gets out he'll be selling £1000 bangers in a back street or filling shelves in Track. Hopefully. 2012 SDV6 - it's missing a couple of cylinders
2008 TDV8 - it was a labour of love and is much missed

It's a disgusting situation, my heart goes out to the injured family.

The reporting does not seem to cover what the devil driver's passenger testified to. I would be interested to know and that passenger may actually be partly / morally responsible for not having the guts to calm the devil driver down vs egging him on. L405 P400e Autobiography (MY2020)... On the BBC News App, England section there is a very short clip of the dash cam video of the D4 swerving out from the traffic about 10secs before the smash..................

Just googled it and it is also on the Telegraph website

Other sources have shown full video including impact and it really is unbelievable this guy only got such a lenient sentence and his passenger is blameless Rolling Eyes

Maximum tariff for dangerous driving is 5 years imprisonment (minus 50% as is usual because the prisons are so full), he would have had maximum 15 years (minus time off for good behaviour) if he had killed the girls. 2020 Pangea Green 1st Edition D240 New Defender 110 is here and loving it

Looks as if he has already undercut a motorist who has put his headlights on before his non indicated madness turn across the oncoming traffic. LR vehicle of course gave the occupants full protection, but the other drivers vehicle wasn't up to help in saving occupants from serious injury. Even the previous motorist to turn wasn't that far off a driving without due care charge. Depending on what the driver was charged with, there is a maximum sentence if found guilty or pleads guilty, of up to 50% off sentence if pleads guilty before appearance. If the occupants had died he would have ended up with a jail term of 10-12 years before any deductions. John

It's always the same thing about justice vs revenge... We all feel bad with such jail time, but where does the justice end and a revenge begins?
What I find reasonable in terms of this sentence is that these 4½ years will leave a grim mark on his life. And then, the earlier he starts paying lifetime pensions to these girls, the better. He owes them his whole life now. Regards etc.,

Wojtek

Grim mark on his life, two and a half years and he's walking the streets again, something those little Girls will never do again. He won't pay anything to the girls it will be JLR insurance that pays which in turn will be us. There are absolutely no mitigating circumstance for what he did. That is the problem with this country too many bleeding hearts and no thought for the victims, somebody will be screaming about his human rights next.

Cheers
Col
