Ebay wheels purchase gone wrong

Today I received the wheels I bought from ebay

Unfortunately thery were not what was advertise in the listing.Not even close actually.First time this happens to me in ebay in many years.

I'm waiting for the final answer of the seller,before I moove to a next level of dispute.

Below are some details with my first communication with the seller

Dear 4x4fixer,

I had received the wheels
My worst fears had been confirm.The wheels are not what you advertise in your listing in multiple ways
Your overall approach prior the sale, avoiding to answer my questions regarding details of the tires,had made me somehow suspicious,but I never thought...
You do not classify "very good" a tire of DOT 2007,and a thread under 5mm,let alone its made
Also closer photos of the scratch marks should had been a more honest approach.The most serious issue however,is that the wheels are not LAND ROVER wheels Your main argument in your listing was their originallity.This is your comment"These are genuine Land Rover wheels and NOT copies"
You are a professional and I'm sure you know the details to distinguish from copys.
These are JWL : Japan Light Alloy Wheels with a "VIA"stamp next to it.
I have in my hands OE Land Rover wheels and I can see in the inside of the wheels(logo,part number etc).
I wait your immidiate comments.I do not want them.Or partial return of money

Well I am really shocked at your comments , these wheels come off a Range Rover super charger and I did answer your questions to the best of my ability.

If you go through the massages I had send you,there are a couple of them asking for the thread of the wheels in mm and what made are the tires.No answer from you in both times.
Your argument about your criteria for the authenticity of the wheels, arised from the fact and only that you removed them from RR super charged,leaves me in shock too!Where did you expect Range Rover aftermarket wheels to be fitted on??
The easiest way you could had check authenticity is to look inside the wheels for the Land rover trade mark,part numbers etc.Another way is check the colour from the inside and outside of the wheels should be the same.In your case its been resprayed and under the silverish colour they used, you can see the real colour of the wheel.
How could all the above escape the attention of a professional,if that is what you are.It really beats me.You had advertised these fake wheels highlighting their authenticity in a way that showed somebody who is sure about something.That is what made you believable to me.
Now what do we do?There are so many threads in Range Rover forums stressing the danger of using non OE wheels.I do not want to risk the safety of my family with 3 young kids riding on those.I do not want them

I had already paid 170euros for transportation.If you had relise your responsibility in this issue,I need my expenses to be paid,and the money for purchasing the wheels to be put back to my paypal account.
Another way I could think to try and minimise the trouble of all this, is to try and sell them locally,since its a good market here and wheels are harder to find.
Ofcourse its hard to sell 2007 DOT wheels on non OE wheels which need refurbish.
I suggest you tranfer half of the amount I had paid you back to my account.I think that is more than fair considering what was advertised,and what I ended buying.
Please your immidiate respond will be appriciated

Hi bazz,
I am very sorry to hear about this and I must stress that I am not an expert so I can only give an opinion. Buying from ebay does give some protection if the items are not as described and you have evidence of this which it appears tthat you do have. Paying via Paypal gives even more protection. I suggest that you contact ebay very soon before you accept too much of a compromise that might leave you out of pocket.

As said, if the response is not as you like, contact ebay via the resolution centre. Very simple, quick and efficient. If the wheels are not as advertised do not agree to pay return postage either, but ask that they are collected by his courier at his expense. Ebay are generally very fair that you should not pay postage to return an item which was wrongly advertised. I have used the resolution centre a few times and even if the seller still has not agreed, ebay has refunded my PayPal payment themselves and then sorted the matter with the seller.

The seller seems to be very accommodating, his reply is courteous and seems genuine.

Am I reading this right, you want half your money back and to keep the wheels?

What do you think?I'm not sure about his genuicity SPX.Yes I did ask him for half of the money to be returned and keep them.As I said I had paid 170 euros to bring the wheels home.Money that I think I'm going to loose what ever the outcome

Maybe he is trying to earn time.Selling the wheels obviously will take time.After a months time in ebay no dispute is acceptable any more

you could try to get him to pay for your original postage, refund what you paid for the wheels in full, and collect the wheels or have him pay for the return delivery/courier.

check the sale of goods act.

these may even be classified as counterfeit goods, ask ebay about this.

however if you're happy with his compromise, go for it, it sounds ok. but you'll be down what you paid for the original postage. Recently bought a 2007 RRS HSE TDV6 for a Pimp-My-Ride-Project.
DONE: Meduza front bumper, AB rear bumper, AB tailpipes, calipers repainted, rear upper tailgate upgrade, side steps, AB front grille, AB side vents, rear LED lights, clear side repeaters, integrated daytime running lights, LED headlights.
TO DO: color code sills and pillars.

You are making life complicated for yourself and the seller by saying you will keep the wheels and obtain a partial refund.

The seller has not attempted to argue and has accepted there is a mistake so what is your problem you seem to assume he/she is going to rip you off ?

If the wheels are not any good why keep them - either you can or cant use them ?

If you keep them how are you going to put a fair objective value on them ?

PayPal and/or a credit card company will only work for you if you cancel the transaction - they wont want to know if you mess about with part refunds - you can do it but you wont have any protection from these organisations.

Keep it simple.

Arrange to return them and inform the seller of the cost and details before you let a courier pick them up and move on.

The seller finaly initiated a partial refund of money through payapal,half the amount I firstly paid.So a happy end(sort of)under the circumstances.I'm left with a set of wheels that had not been my first choice but I can leave with that.

If you thing is complicate to get a partial refund,you should check what it takes to return the wheels!
I have to pay for return expenses and wait probably a couple of months for the outcome.
Actually ebay and paypal"s first propossal is seller and buyer to try and find a solution

Yes you are right!Ι should have known better.Questions were put to him 1-2 days before the end of the auction,and I assumed it might had just been due to work load.Besides his impecable feedback was a reassuring factor

Personally I don't see how paying anything (even if it is half of the advertised price) for something you claim is unsatisfactory and you didn't want is a result.

If you are happy to use the duff wheels then why say they aren't any good ?

You'd be advised to read the Forum threads on cheap and/or counterfeit wheels.

The RRS is a heavy car with (relatively) high cornering ability many owners have had cracked wheel issues just running over pot-holes.

If you're happy that's all that matters but best of luck, I hope you don't need it Thumbs Up

By my reckoning you've ended up paying £290 for a set of 20" alloys with very good tyres.

I'd call that a result.

and then emphasised...

So somehow a 50% refund has been worth the safety of his family !! Or he can find a mug and sell duff wheels that are unsafe (he says) to some-one else !!!

You both have a point.
I rushed into a purchase that it looked risky from the begining.When it prooved to be wrong I had to try and minimise the loss.Considering the trouble involved to rectify this situation,half of the money back is not bad.
I had the right to demand things from the seller,as his sayings in his listing had left him exposed.So in my communication with him I had presented the sitsuation in its worst.
The wheels might not be original,but carry inside marks that proove quality standards.
The "JWL" and "VIA" engraved inside mean:

The JWL standard (Japan Light Alloy Wheel standard) is a set of requirements for alloy wheels set by the Ministry of Land, Infrastructure, Transport and Tourism (Japan) that must be met for all passenger cars in Japan. The JWL mark, cast or forged into the wheel, indicates that the wheel has been self-certified by its manufacturer to meet the standard. There is a related standard, JWL-T, for truck and bus wheels.

The Vehicle Inspection Association of Japan (VIA) independently tests wheels for JWL or JWL-T compliance. Wheels that have been tested will bear the VIA mark in addition to the JWL mark.[1]

We hear cases of broken wheels,but there are all sorts of wheels going around.

At the moment there put for sale locally.Will see how it goes.
