If he entered a guilty plea before the case was heard its unlikely I think that they would proceed with the original S172 case.

Do you honestly think it would be this easy to get off, every man and his dog would just say they didn't know. You genuinely may not know, but u fortunately that's no excuse.

Give the police the 2 names and let them get on with it, that's your only option. If you took some fog and put it in a jar, would it be missed.

As said previously, you need to get your drivers to keep a daily log of ALL journeys taken by each and every driver including driver changes and mileage, this way if it happens again you will be able to sort it out internally and not in the court room. Whistle Thats how i run my fleet anyway.
If neither of the two drivers involved are willing to own up to the offence, tell them your not prepared to take the rap for it either and advise them that you are passing their details over to the courts and let them battle it out, So which seat was you in at the time of the offence Question Laughing Passanger Laughing

It does worry me when people share drive a car and can't say when they were driving or not....I would simply prosecute both drivers for driving without due care and attention if I was the magistrate, certainly higher fine and points than a simple speeding offence and would stop them taking the Censored ......sorry, rant over!

If we're ranting I would rant about this Censored ed up country where you get done for doing 60mph on a motorway because of a variable speed limit with not a workman or accident in site.

You have no idea how much I ranted when I had to attend a speed awareness course for doing 36mph!

I just hate wimps that can't do the time if they do the crime.

Perhaps your company is prosperous, just take the £1000 fine for failing to report details rather than risk an employees licence, after all thats what Alex Ferguson did.

The company is the registered owner, not me personally. You cant give a company points.


The directors can get the rap for it ! just pass on the 2 names and that's it your job is done, if not you will get slammed for not having procedures in place, seriously if it was that easy the whole system would just fail as all you would have to do is say is it was me and my mate and we cannot remember who was driving, it simply doesn't work.

Don't forget the ANPR stuff, there is a possibility that the old bill could get a picture from an ANPR camera that was passed before the offence (they point forward and record permanently) all they have to do is whack in the number and it will show them where the vehicle was etc. (my step brother is on traffic with GMP) the ANPR stuff is scary.... If you took some fog and put it in a jar, would it be missed.
