If that was the case I think they would have to disclose the evidence to the defence prior to the hearing.
Fortunately for us all the police don't decide who gets charged with what the CPS do and have strict guidlines and are generally amenable to doing a deal in the public interest. MY2011 HSE Santorini/Ivory/Piano Black/Privacy Glass/TV .Sadly gone.

Lost me ???? Someone is either a: getting 3 points and a sixty quid fine, or b:6 points and a grand for not disclosing or having the ability to disclose the driver.....

If you get of with it record everything you do because people will pay a fortune to follow the same course of action. If you took some fog and put it in a jar, would it be missed.
