They would have to side with the defender driver. Good job he saw the kid run out into the road and managed to apply the brakes in time.

@ jim4244 - Like Essexfarmer, I think there is a little part related to the RRS being your new pride and joy, I was exactly the same for the first few weeks when I got mine.

So the guy caused an avoidable accident, yeah very bright of him I can't say that I mind being tail gated, I'm too busy paying attention to where I'm going to care how close the person is behind me. |

you're absolutely right - the guy in the Focus did just that ============ 2010 TDV8 HSE - ooo laa laaaaaaaaa 2007 TDV8 HSE - superb car and very reliable ============ 2012 - dearly departed, sadly missed.. to return in late 2013 with a new TDV8! |

If the guy slammed on his brakes for no reason then the biggest proportion of blame is on him. Just because you are rear ended doesn't make it a clear cut to assign blame.

the wrong was driving like a prick behind him in the first place. Until then Defender man was just minding his own business. The focus driver was the aggressor in this situation, and was dealt with appropriately

There is a saying: "only a c t hits the car in front". This prnciple will have been applied by the insurance company and thus the Focus driver will lose the insurance argument. Every time.

Errrr no they won't, it depends on witnesses etc, that's a very common and and wrongly assumed myth. @rrsboy surely the sensible thing to do would be slow down and let the focus past or just continued on his leisurely drive and concentrated on what was infront of him? It seems like it was the guy in the defender acting like the bully. Less than a meter in a 60 for miles? |

this is what my 'society' comment refers to - in what way is the Defender guy the bully?
