Keep pushing them for the full amount, they won't roll over easily but with enough pushing you should get somewhere. As others have eluded to, you need to remember that there in the eyes of the law there is no such thing as a set time period for a warranty as per most manufacturers 'give' you.

2 things are - if you can prove an item was defective from manufacture, the item can be however many years old, it doesn't matter. If it fails they still have to rectify the issue. Repair/replace/refund.

If you can't prove a manufacturing default, then it will be down to what 'the reasonable life expectancy' of that part / item could be. A bit more tricky, but still worth persuing.

Go back to them, thank them for their offer, but you believe it was a manufacturing defect and unless they complete the repair FOC you will be getting an independent report & then going to court to get the car repaired FOC and recovering all reasonable costs. (As long as the report backs you up that is).

+1

the idea that a warranty is only for xx years is complete nonsense, and most people don't realise that. The difficulty comes in after 6 months the onus becomes yours to prove the item was defective/not up to scratch when you bought it (tougher, but not impossible). A car engine, properly serviced, should clearly last long than yours has. Good luck, don't give up. ============

Still only at 50% offer from Landrover, been told to get stuffed (politely)by LR finance so reported it to the FSA.
Now waiting to hear back from MD of dealer chain that sold me the thing.
And have sent in an engineers report and incident report to VOSA as a safety related defect after speaking with them about it.
VOSA apparently can order LR to provide details of all similar failures and could potentially order a full recall of all effected models..................................
Which would make helping me out look very cheap indeed.

Thanks for the encouragement,I did have a chat with a friend who's a barrister and she said pretty much the same thing, and I have legal expenses cover as part of my house insurance and it doesn't seem to exclude vehicle claims.
But whatever happens I can't stop VOSA now if they decide its worth following up.
They did a full recall on the oil ingress into brake servo pump problem on these which caused loss of servo assistance, and a total engine failure has the same effect of course ,plus heavy steering and the suspension going down too.
If a yummy mummy with the kids on board was driving one of these around a bend when this happened it could be nasty, because the steering went bloody heavy and I had both feet on the brake to stop it.

United Kingdom

VOSA wasn't interested in the electronic parking brake, seizing up at every opportunity on the disco3, stranding someone in the middle of the road and wouldn't release, needed to use low range to force the car to safety

http://www.disco3.co.uk/forum/topic43189.h...interested

But good luck though

Thought it was the manafacturer to prove it wasn't faulty?......

the onus switches after 6 months, but that's not to say it's impossible to do. ============

I have the same problem with a 2007 Sport- travelling at 70mph on the motorway when the oil light came on then complete loss of power. Oil fine!Bought the car from new and FSH with Land Rover with 45,000 miles on the clock. Just starting the process at Customer services and awaiting their response. Just wondered where you were at now? I won't be letting this go either!

My problem is the timing belt has snapped off the engine block so will definitely be pushing for complete costs seeing as we have bought 4 L Rovers in 9 years - 2 Defenders for the company in the last 2 years!
It will be interesting to see whether this is a recognised fault - saw another forum with the same year, model and very similar mileage and also FSH.

L R have just offered 85% costs towards new engine - I think that is fair. What I will do after as far as keeping it or chopping in for new (with warranty!!) will have to think about.

it's not fair but it depends how much you enjoy the fight

personally I would push for 100% and costs/effort then settle for plain 100%

but i am quite possibly insane

Thumbs Up

Heap of Censored is fixed ,cost me £4k,complete new engine etc fitted by Stratstones, the invoice makes no mention of any contribution from landrover just has huge discount percentages on everything to get the invoice from the estimate of nine and a half grand down to the £4k.
Have drawn a blank with the FSA because at the time that I bought it from them the value of the agreement was too great to be covered.
Ditto VOSA (so far) but make sure that you file a safety defect report online if yours has the same problem because if enough of us do then they will order a recall and then we all have grounds for a full refund.(And it will cost LR millions)
Likewise the dealer (Lookers) who basically said get stuffed and we'll see you in court if you're hard enough.
So its sat outside being ignored until I can be arsed to get the plate off and move it on.
Probably going to get a Merc or a Grand Cherokee.
Might go and see a brief (but probably won't)
The attitude of big business in this case is almost enough to make me think like a socialist.
But F**k it, life's too short and it was only £4k after all and I had other cars to use.
And its probably worth £2k more than before 'cos its got a new lump with a years guarantee.
I'm almost tempted to keep it and run it until it dies but the missus hates it now because the last two times we've been anywhere far in it, its broken down, first time was the boat show when the alternator died and then a few weeks later, the day after we came back from London the engine let go.
Wouldn't dare to go to the airport in it,who knows what will fail next!
Confused
