Speeding Question

My car was speeding and has a photo to prove it, you can't tell who the driver is, I can't remember who was driving it at the time of the offence, I wrote back to state this and now have a court summons.

If I genuinely can't say who was driving at the time what can they do?

I would imagine the owner named on the logbook would be responsible unless proved otherwise. 2017 Range Rover Sport Autobiography

Are you sure it wasn't your Czechoslovakian friend who has now returned to Czech? Surely they cant add the points to his license can they ? Smile

Registered to company so company cannot receive points can it? or do they go to me as MD?

I would think as the Director you would have a duty of care to make sure you keep records if people use your car as the pool car. Although dont quote me on that . Just a thought. xx Smile

No one's using it as a pool car Shocked , I wouldn't let any of my employees near my beloved RRS!

It was on way back from golf in Sandwich and I shared the driving with my mate, changing every hour as we were both knackered and hung over Big Cry

I had the same thing a few years back.

It is up to the police to identify beyond all reasonable doubt who was driving. My pal is a copper in Sussex and told me this.

Me and my (now ex) wife could honestly not remember who was driving as it was a long trip. I told the police that it was either me or her - as required by EU amendment and left it in their hands.

Tayside police/Procurator Fiscal dropped the charges. Now - MY11 RRS Autobiography TDV6, Orkney gray, tints, steps, daylight running lamps and allllll the toys!!!

Jonny,
Lots of advice on here if you genuinely don't know who was driving at the time and your passenger doesn't either.
You just need to show due diligence and that you have carried out a thorough investigation with your passenger as to who may have been driving at the time.
Clearly you will both be questioned if it goes to court and the consequences if they can prove otherwise are grave i.e. a potential custodial.
Things they will ask you will be such as did you stop to fill up,have a coffee or eat and who drove after that particular break and when did you next stop,they could ask for fuel receipts and then get cctv if they suspect anything.
Have you discussed this with your friend yet?

Have you already got an offence ?
How fast over the limit were you going ?

If no & not much, you may be just as well to take the blame & go to speed school if that's an option ?
no points and makes you a slower careful driver.............unfortunately I don't think every area of the UK do this though.....

I guess 3 points for speeding is a small price to pay considering the above Big Cry As suggested tell them you don't know who was driving at the time of the offence and see where it goes from there,

It was over a week ago and I was hungover, can't remember where/when we stopped......it was 98mph so a 6 pointer?

I would not try the foreign driver route.....ask a very old relative without a car to take the blame....do they check insurance too??

Anyone over 25 is insured so no probs there...........
