They have given me an invoice for £1049, apparently £500 to pay the other dealer within the group for the car, £179 for drive to drive it up, £330 in interest rates, £40 diesel - I feel sick with worry Living the dream!

I would tell them to think again! You were pressured into securing a car without seeing it. If they insist you see it do so and pick up the tiniest fault, scratch or stone chip and tell them they hadn't informed you of these and thatyou cancel your order because of it. I think they havn't got a chance - play hard because they are being unfair if not acting outside the letter of the law. 2005 Zambezi TDV6 - Gone but not forgotten

Looking through other sites about this and it would seem that if you had signed an order form then you basically would lose the deposit as no doubt it would state that it was a non-refundable deposit. The fact that it was a verbal agreement on a car you hadn't seen should help - I don't know legally where you stand but you could always be economical with the truth when push comes to shove. You could say you only gave your details on the understanding that the car was xyz and now that you've seen it y is missing etc etc. 2005 Zambezi TDV6 - Gone but not forgotten

£330 in interest rates

Have the they become loan sharks too? Shocked Interest on what sum? The price of a car that legally isn't yours until you've signed a contract?

My view is that £250.00 would be a fair sum to pay as they had the car delivered from one of their own dealers.

THIS IS NOT VERY GOOD PUBLICITY FOR ANY OF THEIR FRANCHISES! 2005 Zambezi TDV6 - Gone but not forgotten

Question Question Question

Interest payment of £330???

£500 "for the other dealer"????

None of this adds up mate, either we're not party to all the facts here or for some insane reason they're taking you for a mug.

If you've never actually seen this car and the dealer have got hold of it for you to view from elsewhere within the group... regardless of whether or not your circs have changed - you could've got there and found you simply don't like it. If you haven't signed anything, you can't be legally bound to buy it.

Not sure we can help you unless we have the full story and, as Vogue has pointed out, the timeline, facts etc don't tally with your other post.

I can only presume, having read both posts, that you'd paid for the car in full (or the finance company had) and that you'd viewed it at least once. Your circumstances then changed and you asked to pull out of the deal. Hence the charge for the loan interest.

If this is the case then things might be tough although...

I once bought a Volve S60 (don't ask). I test drove it and picked it up but quickly went off it (in about a week). One of the things I didn't like was a slow to respond auto box and I complained that the car wasn't right because of the box, suggesting it was even unsafe. They disagreed.

I then left it outside my local Volvo dealer with a letter and the keys demanding my money back because the car wasn't fit for purpose. The dealer subsequently returned my payment in full.

I have always considered myself very, very lucky to have got away with this.

Looking at the other side of this what is a deposit for - is it not security against the purchase and at risk of loss if you don't follow through?

Agree - we need more facts on this one to provide better opinion....

Shocked

Deposits are sometimes simply to show intent of buying - Refundable deposits are not uncommon. 2005 Zambezi TDV6 - Gone but not forgotten

how can they charge interest with out a credit agreement stating at what rate you will be charged Question

I agree, if the dealer has transfered the car from another dealership, there might be a charge, IF you was aware of it

It *sounds* like we dont have the full story

At all

1 set of posts suggesting he has just taken delivery of a car, but not happy with the drivers seat

Further set of posts suggesting he has not taken delivery of a car, his circumstances have changed and so wants out of the deal

If we combine the 2, we get that he has taken delivery of a car, paid for it, owns it, and now his circumstances have changed. In this case, it seems LR are asking for a nominal fee to cover their costs and are willing to take the car back with no further loss of value. The finance company are seeking, I assume, 1 months interest, or there abouts, and again would be a good deal

Of course, I am just guessing here as this chap makes no sense, so im kind of making up my own story to help me sleep at night..
