Seller has now asked me to pull out of the transaction as he didn't mean to put 99p as a BIN price, only a starting price. What are my rights with ebay? If I refuse he'll just not bother to send them. 2005 Zambezi TDV6 - Gone but not forgotten

I thought that would happen when I read this post late last night.

It may be worth giving the Ebay customer support number a call 02 8080 2105. They will let you know what your rights are.

Alternatively just ask the seller what he was hoping to get for the steps, then offer him a little less because of the way he has messed you around. I think he should at least consider your offer as a way of apologising for his stupidity.

Good luck. Thumbs Up Arctic Frost TDV6 SE. Aspen Leather, Cherry Wood, Privacy Glass, PTI, Tow Pack, Mudflaps, Tasmods, a new Fuelflap, a RRSport.co.uk umbrella in the boot & a RRSport.co.uk sticker on the rear glass.

Oh come on you miserable lot

The guy stuffed up

Did you really expect him to sell them for 99p?

FWIW the sale of goods act would side with him if he were a shop, I have no idea what Ebay counts as besides the Wild West Smile

If somone offers goods for sale at one price then you can say you would like to buy it, but it is still up to the seller to accept that price before the deal can go through.

Many the time you see the price wrong in a shop for example, but their is no legal obligation that they have to sell at that price, even though due to most shop assistants ignorance they do.

Just one eg of what the law is and what the perceived law is.

course e-bay may have its own set of rules Laughing

You might be right lespes but I thought the opposite was true.

I used to be a National Sales Manager for a very large food company managing the Asda account.

All the supermarkets massively scrutinise their on shelf piricing tickets as if it is correct, they have to honour that price.

This is what I was told directly by one of the Asda Category Managers at their head office. Runner up - 2009 Best Avatar Award Sad

lespes is right....there is no legal obligation to accept an offer. The onus is placed on the seller of goods as to whether they wish to accept an offer to purchase or not, even if the price has been advertised incorrectly. However fleabay may have a sub policy which makes allowance for this. Worth a try though VA....

The procurement guy sitting opposite me today says that companies offering goods for sale at a price are offering what is called an "invitation to treat" apparently. This means the seller of goods is willing to engage into a discussion over purchase but doesn't legally mean the goods have to change hands at the advertised price.

Like Super, I must admit I'd always thought an advertised price was what the vendor had to sell for... if not, some big companies have made some errors in that. I remember a few years ago Amazon accidentally putting a load of HP iPaq PDAs up for £5 when they were meant to be £500.... they pulled the ad as soon as they realised but not before a couple of hundred had been sold Wink I know, because I bought 10 of them Whistle
