Perhaps the "fail" part of the username refers to winning friends and influencing people.

No, seriously, I am sure it is well intentioned commentary delivered with passion, and driving a car with a known defect does carry a non-zero risk of prosecution or insurance issues. When my Dad decided he no longer wanted to continue driving, he asked me to sell his car for him. To help it sell, I decided to get it MOT'd so it had a full 12 months ticket, despite there being 4 months left on the current MOT. It failed on a split CV rubber.
The MOT station informed me it was illegal to drive the car after the fail was issued other than to a testing station for a retest or to a repair garage. If caught on the road, I'd have to prove I have an appointment with a garage and that I was travelling to that appointment. So, even though it had a full 4 months left on the original MOT, this was now null and void. I queried this with my sister in law who is a traffic cop, and she confirmed what the testing station said.
No matter what term is left on a current MOT, if it has an interim test and fails for ANY reason, that fail overrides any existing certificate.

Your also allowed to drive a vehicle to your place of residence after a test appointment, with a fail certificate. Although, the law states this has to be via the 'most direct route' which if caught, would have to be demonstrated to a magistrate. If the MOT station mark the fail as 'dangerous unroadworthy' i.e. something like a complete brake failure, then you're not allowed to drive the vehicle on the road, period. Not even to your home or another garage. You have to get it recovered.
The MOT station can't stop you from driving away though, even with a 'dangerous unroadworthy' mark on the fail certificate, only the police have the power to impound your vehicle.

This is what I've said before when you go for an mot and it fails then what ever was left on the old ticket is null and void. Also don't forget you only have 10 working days to get a free retest ..

Can you point to the law that states this though?

The Road Traffic Act 1988 is very clear that if within 1 month before the end of the MOT certificate (or after too) the new certificate is to be treated as starting at the end of the old one. It cannot, therefore, override the old one since it has not, in the eyes of the law, been issued yet.

Now, if it were at an earlier date, it's less clear, but I haven't seen an applicable section of the law that states that an old certificate can be overrided by a new one.

What I am not saying by this, however, is that other offences can't apply as a result - if the car is no longer roadworthy, it is not legal whether MOT'd or not, but that is down to the actual roadworthiness of the vehicle, not the MOT status.

Can't find anyone that can do it sooner and provide a loan car. For logistical reasons, I have decided to park the RRS for the week and hire a car. Will then just drive the RRS to get fixed and I have retest booked for the following morning. This seems to be the only certainly legal way. SWMBO needs her car this week so can't use that.

All a pain in the butt really. 2012 SDV6 - it's missing a couple of cylinders
2008 TDV8 - it was a labour of love and is much missed

What your talking about is when you take your car in for test within 28 days of the expirery date and it passes and is issued with a new ticket, not a fail which as said above is null and void if it fails 2008 G4 RRSport TDV8 current
