Evening all, I'm looking for a few opinions on what to do about a right royal pain the @ss that happened today.

I have a pretty big drive and normally park the cars safely away from the road or in the garage but today because I was running in and out quite a few times and the dog has a habit of trying to escape through the gates I left both my Vantage and Range Rover parked up on the street briefly this afternoon. The road is is wide and straight and generally very quiet except for the odd learner driver doing 3 point turns so I didn't think twice about leaving the cars there while I went to fetch son number two to take to the local cricket nets.

I was just walking back out of the house when I heard an enormous bang followed by 20 seconds of scraping so I run to the gate fearing the worst. 100 yards down the road I could see a BMW sideways in the middle of the road and a huge gouge in the tarmac running back to my cars......ugh.

I ran out and at first glance couldn't figure out what had happened. The Vantage was absolutely fine and it was only looking closer that I could see that the front left corner of the RR had been hit. The damage at least superficially didn't look too bad which didn't seem consistent with the massive bang and the BMW stranded up the road. Thumbs up for Land Rover quality I guess though until it is checked out who know about any underlying issue.

I walked up the road to the stranded car to check the guy was OK, which he was, and to give him a piece of my mind, which I did, and we talked and he gave me his details and apologised profusely and said he only lives round the corner. The impact had ripped the front wheel off his car which he had to just leave abandoned in the middle of the road to walk home. He said he would call the RAC to move it.

My problem is that I had an inkling at the time that he might be , but thinking is one thing and knowing or judging is another so I let it go. Not sure what I could have done other than call the police I guess anyway and would they have come to an accident like that? Not sure.

Anyway when I got home I googled the guys name and a story came up from the local newspaper about him having been convicted multiple times for drunk driving and having hit a stationary ambulance.This made me pretty angry because even though I can't prove it I'm pretty sure the guy was and he was obviously incapable given that he managed to hit at some speed a stationary parked RR on a long wide straight road.

I hope that there won't be any issues with his insurance and I'll get the car fixed up but it leaves me feeling just a little bit bitter and concerned that this guy is driving around in this state and will probably get away with it. It was only a miracle that I didn't have 3 kids in that car at the time as they had just got out.

Is there anything I can/should do?

If at the time you suspect he was driving while drunk you could have called the Police.

If he has supplied his full details (and not false) and no one is injured, then there is no reason to call the Police, and they wouldn't normally attend to a non injury accident.

Bad luck about the damage. Ensure when you submit photos with qthe claim you send, include copies of his car to.
As long as your car wasn't parked illegally or within 15meters of any road junction, you have no problems with claim.
If you smelt alcohol on his breath put that in your report including any indication he was admitting liability. John

At the time I only suspected he had been drinking but gave him benefit of doubt as initially I was trying to be concerned more for his health and thought it was the obvious first thing that springs to mind perhaps unfairly. I'm pretty sure that the details he gave me are correct as I went back to his car afterwards and there was a letter on the back seat with his name and address and then the later googling would appear to confirm this.

He did admit all responsibility at the time. How could he not having hit a stationary parked car but I guess I'll need confirmation from the insurance company first to be sure he won't play silly .

A call to 101 wouldn't have gone amiss, may still be worth it. Not much the Police would do, but you never know. They might decide to pull all the stops and pull his mobile phone records. Looks like he hit your near side wheel almost head on with enough force to break his suspension a few yards on. I wouldn't drive your RRS any further. 

Surely you car would be considered 3rd Party property and it was damaged so the police should have been called immediately. If you had been driving or stopped with hand brake on then it would have been an RTA and no 3rd Party property involved. 1st thing that they would have done is breathalyse the other party. Even though there was no personal injury you should also inform your insurer and it probably isn't too late to inform the police I case your insurer wants a police incident number. 2020 Pangea Green 1st Edition D240 New Defender 110 is here and loving it

Thanks for all the feedback and advice. I had already made up my mind to call the police this morning when they knocked on my door. Someone else had rung them to warn about the car in the middle of the road and it had immediately flagged up as he is disqualified from driving for the previous conviction. They went to his house and arrested him last night but only realised another vehicle was involved when he told them this morning. It appears that he did have insurance even though he is disqualified from driving, go figure, though I'm dreading the insurance conversations and I may have to go to court to give evidence.

The front suspension of the RR must have taken a massive impact so I won't be driving it though it must be said it took the impact very well. These things are as tough as they look which is good to know.

Apologies for the parallel thread on Pistonheads. I would probably be a more upset if he'd hit my Aston because I doubt it would have stood up to the impact so well.

As you say,, could easily have been an innocent party seriously injured or worse which sadly to say happens all too often.

My wife's car is parked outside our house all the time, quiet street,, never any issues, couple of weeks ago someone ran there bumper down the side creasing 2 of the doors and didn't have bottle to say anything,, I'm still seriously off. 2010 RRS, TDV8

My sympathy - someone's parked car slipped it's leash and it rolled into the side of my own parked Sport recently, so I truly can sympahise. The driver also admitted liability and was insured, and my Land Rover insurance (Allianz) seems to be handling things well so far. Mine goes in fir repair in a week or so, we'll see what "like for like" courtesy car turns up.

NB don't forget that as you are the non-fault party, you can insist the vehicle goes to an authorised official LR repairer, not the cheapo shop his insurers will try to foist you off with initially. MY2016 HSE D SDV6 - gone due to fuel dilution problems.

Thanks all. Car is being collected tomorrow to go to Harwoods to be sorted out. Externally there really doesn't appear to be that much damage which I can't reconcile with the noise of the impact and the state of the car that hit it. I would almost prefer there to be more obvious damage so that it is treated seriously. I don't want them to just look at it and assume that it was a parking incident or something minor. I'll just have to make sure I stress it to the garage.

Show repairers photos of other vehicle damage to enforce them to check suspension and alignment etc. When they see pictures of other car they should check everything with a fine toothcomb.

He may have paid for insurance but if he is banned it will be void as he hasn't informed them etc.
As he was driving while disqualified, he has no cover of any type. (I hope you have protected no claims?) John

Good idea thanks. His insurance as you say is null and void. My insurance will pay and I should retain my no claims but will be liable for excess of £400. I can try to reclaim this and other costs from the individual but probably not worth the aggro.
