If at the time you suspect he was driving while drunk you could have called the Police.

Thanks. At the time I only suspected he had been drinking but gave him benefit of doubt as initially I was trying to be concerned more for his health and thought it was the obvious first thing that springs to mind perhaps unfairly. I'm pretty sure that the details he gave me are correct as I went back to his car afterwards and there was a letter on the back seat with his name and address and then the later googling would appear to confirm this.

Surely you car would be considered 3rd Party property and it was damaged so the police should have been called immediately. If you had been driving or stopped with hand brake on then it would have been an RTA and no 3rd Party property involved. 1st thing that they would have done is breathalyse the other party. Even though there was no personal injury you should also inform your insurer and it probably isn't too late to inform the police I case your insurer wants a police incident number. 2020 Pangea Green 1st Edition D240 New Defender 110 is here and loving it

Thanks for all the feedback and advice. I had already made up my mind to call the police this morning when they knocked on my door. Someone else had rung them to warn about the car in the middle of the road and it had immediately flagged up as he is disqualified from driving for the previous conviction. They went to his house and arrested him last night but only realised another vehicle was involved when he told them this morning. It appears that he did have insurance even though he is disqualified from driving, go figure, though I'm dreading the insurance conversations and I may have to go to court to give evidence.

As you say,, could easily have been an innocent party seriously injured or worse which sadly to say happens all too often.

My sympathy - someone's parked car slipped it's leash and it rolled into the side of my own parked Sport recently, so I truly can sympahise. The driver also admitted liability and was insured, and my Land Rover insurance (Allianz) seems to be handling things well so far. Mine goes in fir repair in a week or so, we'll see what "like for like" courtesy car turns up.

Thanks all. Car is being collected tomorrow to go to Harwoods to be sorted out. Externally there really doesn't appear to be that much damage which I can't reconcile with the noise of the impact and the state of the car that hit it. I would almost prefer there to be more obvious damage so that it is treated seriously. I don't want them to just look at it and assume that it was a parking incident or something minor. I'll just have to make sure I stress it to the garage. |

Show repairers photos of other vehicle damage to enforce them to check suspension and alignment etc. When they see pictures of other car they should check everything with a fine toothcomb.

Good idea thanks. His insurance as you say is null and void. My insurance will pay and I should retain my no claims but will be liable for excess of £400. I can try to reclaim this and other costs from the individual but probably not worth the aggro. |
