Yes the consumer law is clear and on your side.

But just make sure you notify your selling dealer BEFORE you spend any cash; if you go ahead without giving them the opportunity to rectify the faults you will loose your rights for anything else going forward.

You can insist the parts are used are LR but not necessarily that the work is done by an LR dealer

Surprise surprise!!

So....called the dealer after getting no response to email re the "clunking" and failed/faulty indicator stalk (too modern it seems.....by the way, on the hunt for a far, found only 10% of dealers responded to emails!!). "Ah right mate....well, you need to call the warranty people directly!". Now, after speaking to you all directly ( Bow down ), I know its not down to any so called, sh*tty warranty. I also researched this myself and even spoke to my lawyer (as I happened to be owed a favour amazingly enough) and the law is quite clear. The dealer "gives" warranty with every car and I suspect, relies on people not knowing how consumer rights have changed over the years (i didnt know and having spoken to others, lots of people dont or rather, didnt know!) and therefore, relies on people going to the warranty company when told and then when that doesnt work out, says the old dealer line "Sold as seen mate...musta got the fault after ya bought it!" and fobs them off. Anyway, i am going to play his little game a bit more. I take it to Landy today, get official diagnosis. Then I will get a quote to fix. Then I will call warranty lot to be told they dont cover it and then I go to the dealer and say "Right then sunshine, this needs sorting and YOU are responsible for it!" and will go from there. I want it done by Landy or an Indy, as the cost isnt huge (new indicatpr switch will be the pricey bit I reckon and I would even fit that myself), but I dont want some back street idiot that I know nothing about, getting his hands on it. I also change jobs as of this Thursday and have some meetings and appointments coming up that I cannot be missing due to a garage saying a specific day and then taking 4 etc......

So watch this space! Again, i cant thank you all enough.....bloody good forum Thumbs Up Supercharged and proud.....!

switches aren't switches any more (in the sense of completing the lighting circuit to make the bulb illuminate).. they're just "communicators" that tell the ECU via the CAMBUS (or equiv) that you have moved the stalk. Then the ECU tells the light, again via the CAMBUS, to flash.

You're right....however, in this case, the "switch" will do as it is told with some wiggling....so i think it is the culprit. Will get it looked at in 30 mins....just off to Lancasters to have the clunk AND indicator issue looked at!

So....switch seems to be the culprit re indicator....waiting on price.

Would the bloody car "clunk" when I had the Landy tech in it? NO! It drove spot on....And lo and behold, no space on a ramp unless I could wait....which I couldnt!

So....will take it to MID tomorrow in Wantage and get them to put it up and pry around with a bar (gently ish) to see if we can see which bush is playing up. Balls Censored thing..... Supercharged and proud.....!

Reasonable?

At the risk of becoming some sort of Pariah and not knowing how much you paid for your car I'm forced to suggest that we all need to be reasonable.

Is it reasonable to expect the same degree of fitness for purpose in a much used car sold for a fraction of the price of new?
Is it reasonable to sell a vehicle knowing there's a fault and hoping to get away with a warranty fob-off?

Certainly not in either case, we have to be reasonable.

I was a trader for 18 years and I can honestly say I never sold a bad car (to a retail customer) but with the best will in the world we had problems because at the end of the day we were selling used cars. If we had made a good profit we would always be prepared to spend more on warranty costs but there's a limit. I think in legalese the term used is 'betterment'.

If you bought a used car you can expect all of it to have been used and in need of replacement, service or repair at some 'reasonable' point. It's not reasonable to expect any part of it to be in new condition (unless that has been claimed by the seller obviously)

I'd like to think that I was always fair with my customers and did my best but the unfortunate truth is that I left the trade because I was fed up of being tarred with the same brush as the bad guys by virtually everyone. When I read some of the comments and responses on forums like this I feel that we can all be accused of being a little unrealistic at times.

Me included, I feel just as peed off with teh guy who sold me a new shape mini for the missus last year, less than a thousand miles in it and its cost me £800 for a clutch and an MOT. But he didn't build it, he wasn't driving it when it all went wrong and I'm pretty sure he's spent the profit he made on the deal a long time ago, meanwhile we still have the car. Hey ho.

Hope I haven't ruffled any feathers here guys (and gals), not my intention at all and if it wasn't public it'd be none of my business either but there it is and here we are. It's okay knowing your rights and rushing around thrashing everyone with them but you can take it from me, you get a lot more done with a kind word and a pastie than you do with just a kind word. If all else fails then fill your boots making solicitors rich but be reasonable too, the judge has to be.
