Unbelievable!

So....driving home this moring at 10.30, doing 10-15 mph up a small lane in my village when along comes some cutn in a white VW Caddy travelling at 40 mph in the opposite direction.

I stop and watch as he skids 50ft along the lane smashes into the FOS of my car continues down the side up a 3 ft grass bank and through a hedgrow into a neighbours garden.

Luckily nobody hurt.

Police attend and breathalise the pair of us, check details etc.

I inform my insurance company (ADMIRAL) and send them photographs showing 50ft of skid marks from the van that hit me whilst I was stationary.

3 hours later ADMIRAL send me a letter via e mail stating "Our view is the drivers involved should share responsibility for this incident".

So thats that then.

I'm guessing at around £5K to repair my car New bonnet, new FOS wing new bumper new headlight new alloy new drivers door etc,

Moral of the story - drive like an arse as if you have an accident that is not your fault you will still be blamed for it!

Thats rotten , but it is how insurance companies work,sharing the cost is cheaper for both camps. I would reject that offer and get a copy of the police report to admiral.

Glad you are ok Jim but that is disgusting from your Insurance company.

I would't agree to that and as Codfarther said, get a copy of the police report to them (if it reads any different of course)

Definitely pursue it with the insurance company, and say you're not happy to settle for something that is clearly not your fault. They'll take the easy option where they can, but its worth getting them to see your point of view, even if you have to climb a few rungs up the ladder Thumbs Up

I think they'd all be the same to be honest, if its not clear cut, then they settle for 50:50 and shaft you next time around when you renew.
I'd definitely tell them you want to push for the other arty to be blamed and all costs covered by their insurance. ON THE WAY: BMW F21 M140i

I agree with all of this - glad you're ok, but get back onto the insurers and tell them you dont accept any responsibility, hopefully supported by plods report, otherwise youcan kiss your XS goodbye and watch the premium rocket come renewal.

Insurance companies make my pi$$ boil. Few months ago my sport was ran into by a run away car where the owner hadn't fully apllied her hand brake and my insurance has gone up by £50 because I have to declare a no fault accident.
Penalised and I wasn't even in the bloody car Censored

I agree, don't admit blame if you can help it. There are insurers out there who don't rate non fault so you can always change at renewal and wouldn't want a claims at there for 5 years.. 2007 TDV6 HSE Stornoway Grey

Easy - have now handed everything over to a LR approved claims management service.

RRS being picked up tomorrow and a Porsche Cayeene dropped off, as there were no RRS available. Poorly car will go to a LR approved bodyshop, which I have been invited to inspect tomorrow morning.

Have sent all my photo's in and passed on the attending Police Officers details and the claims management guy fully agrees with me that I was blameless in the collision.

Feeling a little bit happier now.

Also really sorry to hear this jim Shocked Glad you wasn't injured, don't accept any blame whatsoever, if someone hits you when you were stationary, then its 100% their fault not yours + the other driver is at risk of driving without due care and attention if the police choose to pursue it. Hope you get it sorted asap, but your new motor will never seem the same again which is the worse thing when something like this happens Big Cry

I was invited to inspect the bodyshop where my RRS will be repaired. Very impressed!

The owner really knew his stuff and he showed me some of the vehicles that are currently being repaired.

The Porsche has just been delivered. A bit different from my RRS and a petrol engine to boot, but a lot better than the Citreon C3 that Admiral offered me.

The claims management company that are now dealing with everything are called "Accident Exchange" anyone ever dealt with them or heard anything about them?
