In my relatively short experience of driving of 7 years.
Had one major accident when i was 17, guy drove into the side of my 96 Ford Escort 1.6 16v Ghia when i was stationary and waiting to turn right.

Even though i had a witness (who soon decided he couldn't be bothered to help) i got the blame! beign 17 at the time with 2 months experience, and the other guy being 60 something, with over 40 years no claims the insurance wouldn't fight my corner for me! he claimed i edged out, when i didn't he crossed the white lines and bang, knocked me into next week.

Apart from that, had a few close shaves, but no other accidents yet fortunately.
so have a collection of 6 yrs NCB to date, 3 speeding tickets though, and always seem to maintain a collection of 6 on my license, soon as a set go, i get caught again!?

Well it was a great start to the weekend - opened post on Saturday morning only to receive a NOTICE OF INTENDED PROSECUTION

It states they recorded me driving at 37mph in a 30mph zone Embarassed .... on the 7th December 2005 @ 19.20 on the B4666 Coventry Road, Hinckley

HHHmmm ? .... if I was over the 30mph limit ? I amazed it was/is 37mph . I saw the Police van from some distance - your heart flutters - foot on brake - look at speedo - it was on 30 - SO - I must have been a tadge over 30 at the time I put my foot on the brake - But - in my mindset I knew I was tootling/dordleing along Crying or Very sad - but 37mph

Also am I correct that the camera used should have been checked within the last 6mths.

If so I am right on the edge/limit. As my alleged offence was on 7/12/05 and letter dated 9/12/05....... the link to Leicestershire speed site shows all certificates for all cameras used.

as mine was in the back of a van - I presume it is the mobile camera certificate I need to refer to ....

this above link displays all 6 certificates for this catagory & they are dated

1/10/2004..... yes 2004

So even from the date of event -there are only 2 certificates dated within 6mths that may apply ( those dated 9/6/2005 ) but then they equal the date of the letter.

I have requested the photographic evidence - this will display the necessary info.

Oh dear... 37 in a 30 is one of those offences that is clearly just a waste of police (and the intended prosecutee's) time. There are obviously lots of avenues open to you if you wish to contend it which have been previously discussed.

The cameras need to be certified at least once per year, so they are all in with the exception of the certificate dated 1/10/04 - it would be nice if it was that gun that they used on you! It's true that the LTI guns are known to be woefully inaccurate - there was even an episode of one of those consumer programmes on TV a few weeks back where they ran some controlled tests and found the usual brick wall travelling at 20mph etc. They faced a couple of traffic divisions with the results but their response was as expected: "I'm afraid you didn't do the tests correctly - those guns work just fine"...

TC , now I,ve got xmas out of the way I need to sort this issue out Sad
I have received the photographic evidence ( its pitch black and you cannot see a damn thing apart from the numberplate )

Any suggestions

Not that I can see, they have only sent two photos - what if theres more?
How can I defend my self - or prove I was going less than 37mph? Apparently if I had been doing 36mph then they would/could have offered to send me on the spped awareness course> all for 1mph?

The only white lines you can see are those of the centre of the road. ( just )

As far as I know that means they can't prove the speed - but some one who knows more than me might be able to expand on this. Over christmas there was a case where some one proved he was doing only 18mph but was clocked at almost double. The fact that a large bus was on the other side of the road caused the gun to misread. My thoughts are that unless there are 2 identifiable points on the road that you pass the police cann't prove your speed. 2005 Zambezi TDV6 - Gone but not forgotten

Prosecution have to be prove 2 things:

a) Identity of driver
b) Identified vehicle was speeding

They can only prove 'a' if you admit that it was you driving but if you're not the only person with access to your car then you may have a defence

They can only prove 'b' if they were using approved 'measuring devices' and they are 100% certain it was you driving your vehicle.

Get a good solicitor now and do not complete any forms or sign anything until you do!!!

In my experience, the camera operators aren't above incompetance or downright lies Crying or Very sad
A few years ago, I was banned 2 weeks for driving at a claimed 104mph on the A27 at Devil's Dyke near Brighton past a layby full of marked police cars and bikes. Mad
There was absolutely no way that I was doing anything more than 70 as I had seen them more than 2 miles away and had adjusted my speed accordingly. I did get a solicitor but he advised me not to contest it as I would be calling the police officer into question and they don't really like that Confused There were no pictures as it was VASCAR i.e. time & distance.
