Not sure if I got zapped last night or not?

Went out to local B&Q in search of xmas tree lights etc - no joy - but on way home out of Hinckley town centre 30mph for a while befor changes to 40mph I was tootling along but in excess of 30...... saw a camera van , I braked, I know I was doing less than 40..... but exactly how less I dont know ....... I was certainlt doing 30 for a number of yards well befor passing the van

Now I just have to sweat for a few weeks

Bad luck but if you were only 1-2mph over you might be alright. I remeber seeing a programme the other day showing that the majority of speeding fines can be appealed because the signs, markings etc are not legal. Example - the 30mph sign sits on a square plate with a yellow background, this apparently makes any fine void as the official sign should be circular with and outer red border and inner white with 30 in black. I know the signs are ok

I was told - always ask for the evidence, also remember reading an article in the sunday times re this subject.

With fixed-location cameras, you normally get sent (or at least get sent a URL to it) a copy of the photographic evidence if you are caught & recorded. But with mobile cameras it is absolutely vital to ask for evidence if it's not provided with your notice of prosecution.

The word on the inside says that the mobile cameras are meant to receive calibration and therefore certification only once a year, but (a) the year rule is very loosely adhered to and cameras can go up to 18 months/2 yrs before they get recalibrated and (b) it's well-known for them to lose calibration very quickly so potentially a camera with a month-old certificate could be inaccurate enough to argue about.

Obviously all this comes from the Force that my bro works on, your mileage may vary. I'm sure you weren't singled out, MDP. It takes a couple of secs for the camera to provide a reading so if you braked as soon as you saw the camera and there were also other cars in front of you then I expect you have got in under the wire. Keep us posted as to your goings on - also, you should find most forces are pretty quick at getting notices out these days. 9 times out of 10, if you haven't heard in a couple of weeks you're probably not going to hear anything.

Did i read somewhere that they have only 14 days to serve the NIP or else it wasn't valid? So once the 2 weeks is up he's safe anyhow?? HSE TD6 (Java Black/Ivory)

If that's the case, it's a recent development. Last points/fine I got (earlier this year on the A303 at 87mph, thankyou Mr Gatso)... I didn't get the NIP until about 4 weeks after the event. Mind you, if I'd have known about that possibility, I'd have contested it... I'll see if I can find out.

States that in order to prosecute you, the Police force in question has to send you the NIP in 14 days. If it after this, you can contest.

There are lots of ways to delay the inevitable and also get out of points and fines, and the best I can suggest is to look at this superb website, with contributors who know the letter of the law, they will give you advice if you need it.

When I was done twice in Scotland in a week, I contested one of them and managed to delay paying the fine for 4 months, the evidence clearly showed it was me at the wheel but I still went through all the motions. Most people don't and just cough up without asking.

If I'm right then if you are done by a GATSO, they have 14 days to get the NIP to the registered keeper. If you were driving a company car then as long as the company are notified, they then have 6 months to get you!

Requirement of warning etc. of prosecutions for certain offences

1.—(1) Subject to section 2 of this Act, where a person is prosecuted for an offence to which this section applies, he is not to be convicted unless—
(a) he was warned at the time the offence was committed that the question of prosecuting him for some one or other of the offences to which this section applies would be taken into consideration, or
(b) within fourteen days of the commission of the offence a summons (or, in Scotland, a complaint) for the offence was served on him, or
(c) within fourteen days of the commission of the offence a notice of the intended prosecution specifying the nature of the alleged offence and the time and place where it is alleged to have been committed, was—
(i) in the case of an offence under section 28 or 29 of the [1988 c. 52.] Road Traffic Act 1988 (cycling offences), served on him,
(ii) in the case of any other offence, served on him or on the person, if any, registered as the keeper of the vehicle at the time of the commission of the offence.

It's the difference between NIPs and FPNs... it seems they must deliver NIPs within 14 days of the event and FPNs within 6 months. I wasn't aware of this... so I potentially got 3 points and a 60 quid fine for nothing. Nice. Everytime I see a camera, my blood boils at the best of times... I'm not best pleased that I could have contested. Hopefully, as I tend to drive the RRS in tootle mode for the most part, I won't be getting caught anytime soon.
