I haven't owned an X5 but test drove one (3.5d I think) about 2 years ago. I had a 2009 RRS at the time which I was very happy with but was considering X5 and Q7 just for a change. Steering felt heavy and the salesman's explanation was this was to help keep the car straight under quick accelaration from standstill. He tried to tell me X5 was quieter than my Sport and didn't believe me when I disagreed after a short test drive with him up the M1 Wind and road noise was consiederably louder than RRS (which was older than the X5). X5 was definitely quicker but not by a huge amount to make it a deciding factor. However, I may not have pushed it hard enough.

£13k isn't a big budget. Do you have budget for upkeep too? If not neither is likely to be great choice as both have issues that can bite. The RRS is more likely to be expensive to run too.

I've had a few of both, all bought at about same age, used more or less the same. Never had work done on the BMWs.

RRS is an offroad vehicle and works really well onroad but an X5 is onroad only.

That pretty much sums up how LRs are. The figures don't always add up, they often seem the worse choice...but you get in one and they just aren't! A high mileage TDV8 might be quite a good option if it happens to have had a new turbo or two and the gearbox has been looked after. Otherwise a lower mileage TDV6 is probably the safer bet. High milage on these cars isn't really a problem though, and can mean lots of stuff has been done. What sort of mileage will you/it be doing? If fairly low, have you considered a petrol model? The increased fuel is offset a little by a lower purchase cost, and they are, of course, immune to the turbo issues that can affect the diesels.

we will not be doing many miles to be honest 10k a year maybe a little more or less but don't think i could handle 15mpg or what ever it is and they is not much difference in price between petrol and diesel models.

I found the X5 to be lifeless and boring both inside and out, like most BM's of recent years.
