Broken New Car

I wasnt keen to make my problem public but i want some advise on how to proceed.

Collected new 65 plate with 8 miles on the clock on 10 days ago. Drove the car 5 miles to a gearbox warning so returned it straight away to the dealer.

Dealer has had the car 9 days and the fault is not fixed. First gearbox control unit changed which took 4 days for LR to diagnose but now they cant program it to get the car to work LR still havent fixed it im waiting to find out how long i have to wait as dealer accepts its not acceptable to not give me answers but its not in the dealers hands as LR are requesting details of the car then advising what to do etc.

So the way i feel i paid alot of money for a new car i waited 16 weeks for.
I took delivery of it and drove away in my new car for 5 miles less than 30 mins of driving.
The car has now been with the dealer for 9 days it still isnt fixed.

I feel the reason to buy a new car is not just for the car but also the experience of a new car and then getting to use that new car but i just feel this new experience hasnt gone well and now 9 days later i feel my car now feels second hand to me as the excitment of getting my new car has now turned into disapointment.

I feel my options are

Let the car be repaired at some point in time when LR give the dealer the fix.
( This option makes me feel as i say that my car is not new anymore so ive lost that new car feeling of ownership )

Reject the car as faulty and request a new car is ordered for me.
( Assuming the dealer would even accept this how long do i then wait for a new car do i get a priority new build or is it another 12 - 16 week wait ?

Dealer so far has been good to me but i am frustrated with what appears to be LR not looking to apply solutions and fixes for my car. My words to the dealer was you can build a new car in 4 days so why does it take 10 days to get answers on fixing a brand new car.

If the car was fixed quickly i wouldnt mind but its getting to me now so just need some advise PM me if you prefer just feeling sad now all i have is some picutres and a loan car which isnt the same.

Other people will know more than me, but I doubt you are anywhere near the point at which you can reject the vehicle as faulty. The quickest and most sensible option is probably to let the dealer get on and fix it as fast as they can, while in the meantime you just keep reminding yourself of the following:
1. It's just a car
2. Some faults can take a long time to diagnose and fix
3. You've waited 16 weeks already. Another couple of weeks isn't the end of the world, and a lot less than having them build a new car for you.
4. It will still feel pretty fab when you get it back.

Having said all that I can imagine it must be pretty frustrating. The solution is out of your hands, so in the meantime you can either decide to get angry and disappointed about it or adopt a calm zen-like attitude. Neither will make a difference to the outcome, just to how you feel about everything.

As somebody who has rejected a car I would note the following:

1. Your contract for the supply of the car is with the dealer. LR is irrelevant and they are usually reluctant to intervene as their contract is only with the dealer

2. The dealer should probably have noticed the defect - if it occurred after 5 miles from delivery - in their PDI check. In my experience these are rarely done properly. The dealer should then have rejected the car supplied under their contract with LR

3. If it broke after 5 miles I think you are well within your rights to request a refund - if you bought any other product got it home and found it didn't work you would return it and ask for another one - if one was not in stock - like a car - you would ask for your money back and go elsewhere

So firstly decide what you want - your options at this stage are probably a fix or a refund. If you want another car ordered I think you will need to exhaust the fix option first. Remember your contact is with the dealer - Not LR - so I would have no sympathy with the dealer not enforcing their contractual rights with LR for supplying a faulty car to them. As a franchised dealer it is not in their interests to be too robust with LR!

If you have taken out finance on the car then get the lender involved, they own the car until you make the final payment remember. You have a duty of care to look after it and make sure it is taxed and insured during the "rental" period. A member here recently got their lender involved and got the result they were looking for pretty quickly. 2020 Pangea Green 1st Edition D240 New Defender 110 is here and loving it

I really feel for you and understand what you mean , my dealer is beginning to annoy me and I feel they are taking sum of the fun out of the new car experience .

Thanks for the support guys i have submitted a letter to the dealer today to make things official.

The dealers own service to me has been great upto yet and i expect it to stay that way so i cant fault them.

I beleive my case is strong if the factory or dealer had driven just a few more miles before delivery this problem would be theres and they would not have given me the car on the day and had to replace it i imagine. Its not like ive had it a week or two and done a couple of hundred miles we are talking about 5 miles or 20 mins in the car before failure in a way its unlucky it didnt happen before it left the factory then i wouldnt be in this position now.

I will update the thread when i have a outcome.

Dont let this put you off new car buyers im not put off and will be in a RRS for sure, i am also looking to buy a Evogue this is just a one off problem.

Just reject straight away, not fit for purpose is no doubt at 5 miles,

Finance company immediately, unless the dealer plays ball, orders new motor and put you in a car till it arrives, this has been several times before with similar issues Thumbs Up None currently

Until you know what the problem is then you can't be sure when the problem would have occurred. With you it ocurred 5 miles after delivery, but it might just as easily have waited until 50 miles or 200 miles. In addition, I think many new owners would be a bit sniffy at picking up a 'new' car with 100 miles on the clock just because the dealer though he should check the gearbox, or whatever. It's incredibly bad luck and perhaps the dealer should be doing more to fix the car a bit quicker, but rejecting the car prematurely might just be cutting off your nose to spite your face.

BTW, any update?

True about mileage I wouldn't want miles on it by the dealer but I don't blame the dealer for the problem but they have to sort it.

So update so far is

Car was returned to me repaired after 14 days. Gearbox control unit was replaced and reprogrammed to the car.
Dealer told me to have it back and wait reply to my letter.
As I am not sure it's fixed 100% as its a bit jerky.
Dealer has checked this today and confirmed they feel it at stone cold start as per my report. I've said it's not normal as the car I borrowed overnight didn't do it this morning on me.
Car is going back in the dealer late next week to have the gearbox recaliberated.

Glad to hear there is some progress. While the dealer continues to be helpful and the car continues to improve then I'd stick with it if I were you. The. chances are they will have it sorted a lot quicker than you rejecting the car and waiting for a new one.

IIRC you have to give the dealer 3 attempts to resolve the issue before you can reject a car anyway. 2020 Pangea Green 1st Edition D240 New Defender 110 is here and loving it

This may depend on circumstances but this is in no way acceptable to me in my circumstances.

Hi Dave,
The car still has a problem disengaging the clutch when cold every day.

the car is been replaced for me with a new build car so that is acceptable and puts an end to my worry.
