So there I am driving on a dual carriageway right hand lane about to overtake a dark blue Volvo at 70mph cruise control set, long way ahead a truck can just be seen moving along a layby indicating to come out, dark blue Volvo short distance ahead of me decides to pull out in front of me causing me to brake fairly heavily. Not a good or clever manoeuvre as there was sufficient time and road to let me pass him. We both eventually pass the truck and I move back into the left hand lane. The volvo remains in the right hand lane even though the road is clear ahead. We are on a slight hill so both cars are decelerating, so as the Volvo draws back slowly but surely Ive now at the same time re engaged the cruise control and car accelerates back to 70mph. this puts me alongside Volvo which is still drawing back, he remains in the outside lane.

He stated that undertaking was the issue. more worryingly during interview in the car he asked three leading questions..one was 'did I agree that conducting a manoeuvre like that at 70mph was dangerous'

To me undertakinmg is when a car whistles up behind you nips into the left hand lane, shoots past and then probably comes out again to overtake the next car. What you did was caused by circumstances and not a deliberate act. Sounds like a slow day for the plod.

I don't think you get a choice with a driving without due care charge - you'll get a summons anyway. It does sound like a bored plod looking for someone to pull. One might even suggest that it was entrapment... 2012 SDV6 - it's missing a couple of cylinders 2008 TDV8 - it was a labour of love and is much missed |

Sounds like the plod was the one driving without due care and attention to me. Driving in the overtaking lane when not overtaking is now an offence. It sounds like he was trying to push you in to committing an offence. Which he obviously did. I would take it to court. I would also pay his station a visit, and explain the situation to his superior, letting him know your full intentions to fight it in court.
