So there I am driving on a dual carriageway right hand lane about to overtake a dark blue Volvo at 70mph cruise control set, long way ahead a truck can just be seen moving along a layby indicating to come out, dark blue Volvo short distance ahead of me decides to pull out in front of me causing me to brake fairly heavily. Not a good or clever manoeuvre as there was sufficient time and road to let me pass him. We both eventually pass the truck and I move back into the left hand lane. The volvo remains in the right hand lane even though the road is clear ahead. We are on a slight hill so both cars are decelerating, so as the Volvo draws back slowly but surely Ive now at the same time re engaged the cruise control and car accelerates back to 70mph. this puts me alongside Volvo which is still drawing back, he remains in the outside lane.

eventually some 40-50 seconds later a slow moving car in the left lane requires me to indicate to pull out, the dark blue Volvo is still in right hand lane but a small spec in my mirror. I overtake the car and still the Volvo remains in the right hand lane, eventually some 12 minutes later the blue Volvo decides to pull me over (yes you've guessed it a police car) he then decides that its driving without due care and attention........so have I been hard done by????

Its not technically illegal to undertake another car but there is a big onus on you to do it safely. You weren't speeding, you were aware and can recount precisely what happened, you made your lane changes safely and in good time.

What did the policeman (who wasn't obeying the highway code) alledge?

At the end of the day its your opinion against that of the officer but from the sound of it, worth arguing in court in this instance IMHO

He stated that undertaking was the issue. more worryingly during interview in the car he asked three leading questions..one was 'did I agree that conducting a manoeuvre like that at 70mph was dangerous'

that one got a I did not agree that any dangerous manoeuvre had been conducted

I also asked if I could photograph his notes and therby get a record of the interview with my phone camera......that one got a refusal....would be interesting to know if that was correct

sounds like he was been a right tool

But it should be also on his incar camera recording the incident as evidence, see if you can make sure they include the moments leading up were they pulled out on you

To me undertakinmg is when a car whistles up behind you nips into the left hand lane, shoots past and then probably comes out again to overtake the next car. What you did was caused by circumstances and not a deliberate act. Sounds like a slow day for the plod.

A while ago I was driving along the A14 on a Sunday morning, clear road and doing 70 cruise engaged. Ahead I could see two patrol cars parked in a layby. I checked my speed and continued. After passing them I checked my mirror and saw the two Volvo T5s pulling out. They caught me very quickly and the first one sat behind me so close that I couldn't see the bonnet in the mirror. The second one sat outside him in the right hand lane in formation. I checked my speed again and continued. They held their positions for 3 miles, so close that had I braked the one behind me would have hit me. I didn't flinch, just got more and more angry. After 3 miles the outside car shot past and the one behind me pulled out and followed him. They pulled away at high speed, well over 70 and with no lights or sirens.

I wrote a full report to the Chief Constable of Suffolk, but unfortunately didn't have a recording of it. I got an acknowledgement from a minion and some limp wristed excuse. I'm afraid it changed my view of traffic coppers, and not for the better.

Sounds like the plod was the one driving without due care and attention to me. Driving in the overtaking lane when not overtaking is now an offence. It sounds like he was trying to push you in to committing an offence. Which he obviously did. I would take it to court. I would also pay his station a visit, and explain the situation to his superior, letting him know your full intentions to fight it in court.

I'm seriously thinking about a dash cam also. Fail to see the downside of one.

Interesting one that...don't think there was ever enough evidence to prosecute and it would have been fought..

so a compromise for both sides
