I purchased a 2006 RRS HSE 2.7 TDV6 back in January. It was supplied with a full years MOT/ 1 months warranty and a full service "which i never trust". Anyway i drove the vehicle for around 7/10 days prior to returning back to work offshore.
On my return i began to notice some faults and niggles.
i.e. a knocking noise in the suspension, a vagueness in the steering, the front parking sensors don't work, the o/s/r passenger door doesn't lock and the n/s/r passenger window won't operate from the driver's console.

As i always have my vehicles serviced as soon as i buy them for piece of mind i asked the independent land rover specialist to look into the faults.

The Engineer was amazed the vehicle had passed an MOT without any advisories only four weeks previously and had only traveled 300-400 miles since it's MOT. All items in his opinion should have been advised as a minimum on the MOT with 40% of the faults being an MOT failure. The faults listed as a failure are -

a) all brake pipes excessively corroded and require replacement.
b) center propshaft bearing housing cracked and perished giving excessive movement
c) both front lower suspension arms in an unserviceable condition
d) OSR and NSR suspension arm bushes cracked and perished giving excessive movement

my previous work role prior to working offshore was a PSV mechanic and i know the service engineer wasn't blowing smoke up my ass
Cost to have all this addressed is almost £900

The Service Engineer said that I, the Customer should not be liable for these costs as the faults should have been noticed and rectified during the vehicles mot.

i have since contacted the company which sold me the car to shed some light on my query's but to no prevail !!
i have also contacted the garage which done the MOT and once more they are un responsive.

Any advice would be appreciated

I believe that you can contact VOSA (find your local office) and complain to them. They do another MOT on your car (about £50) and compare it to the original test centre.

If they believe it should have failed or had advisories noted then they contact the test centre to find out why the incorrect action was taken. They can remove an individuals tester licence or the entire test centre one.

The dealer appears to have sold you a non-roadworthy vehicle. That's illegal so talk to Trading Standards if the the garage won't talk to you. 2012 SDV6 - it's missing a couple of cylinders
2008 TDV8 - it was a labour of love and is much missed

Once VOSA agree that the car should not have passed an MOT, then go back to the dealer saying that the car was not fit for the road and you are notifying trading standards.

Did you pay for any part of the car with your credit card? Even a deposit of £100 or more? If so, your credit card company are also liable for the full amount of the vehicle up to £30,000 (Section 75 of Consumer Credit Act 1974).

i think you should name and shame them ! Recently bought a 2007 RRS HSE TDV6 for a Pimp-My-Ride-Project.
DONE: Meduza front bumper, AB rear bumper, AB tailpipes, calipers repainted, rear upper tailgate upgrade, side steps, AB front grille, AB side vents, rear LED lights, clear side repeaters, integrated daytime running lights, LED headlights.
TO DO: color code sills and pillars.

This will come under the sale of goods act, its not fit for purpose, the mot tester has obviously ignored the faults so I'd push on the garage asking why he passed it , I've gone through this and won, I'm away to Aberdeen as we speak to do do my trip, I'll pm you some stuff so you can be armed and ready.

When you buy as a consumer from a motor trader, your legal rights under the Sale of Goods Act 1979 cannot be taken away or reduced. An example of an attempt to do so is a notice such as ‘sold as seen’. Such phrases are meaningless and cannot alter your rights. If you see a sign of this type, report it to Consumer Direct on 08454 040506. A warranty or guarantee can only be given in addition to your legal rights, not instead of them. You can take legal action under the Sale of Goods Act 1979 for up to six years after the date of the contract, but it is unrealistic to consider legal action for defects on used cars – especially older vehicles – once you have had them in use for a reasonable length of time. Each case is different, so it is best to take advice before you decide what to do.

It may be cheaper to buy cars privately but look at the protection you get when buying from garages

If the goods where purchased withing the last 6 months (new or second hand & in the case of car age is not very relevant when you talking about such a major component) then you can demand either a replacement of equal value or a suitable repair & you don't have to prove the fault appeared AFTER purchase. In law it is assumed that the fault existed prior to sale

& this is why

"reversed burden of proof"

Means that for the first six months the consumer need not produce any evidence that a product was inherently faulty at the time of sale. If a consumer is seeking any other remedy the burden of proof remains with him/her.
In such a case, the retailer will either accept there was an inherent fault, and will offer a remedy, or he will dispute that it was inherently flawed. If the latter, when he inspects the product to analyse the cause, he may, for example, point out impact damage or stains that would be consistent with it having been mistreated in such a way as to bring about the fault.
This reversal of the usual burden of proof only applies when the consumer is seeking a repair or replacement. After the first six months the onus of proof is again on the consumer.

If you have already advised the dealer of the fault you must act now!

Incidentally the 30 day warranty you referred to is a load of bull & con by the dealer. The dealer can't limit his liability to 30 days & if the dealer suggests or advertises otherwise he is committing a criminal offence under the trades description act............unless (& I have mentioned this before) he adds "This warranty does not affect you statutory rights" in writing that can be read & is in plain sight

He is correct and all this is covered by sale of goods act. Fit for purpose etc. my advice would be to write and send by recorded delivery, giving them 7 days to arrange to get the car back, inspected and rectified, and if this is not done, you will take action to recover the repair costs or the entire value of the vehicle. If they don't respond, then invest £56 and take out an online case in small claims providing written evidence of loss or projected loss. The rest is history. Don't phone them, keep email and letters if they respond.  2x TDV6. SE and HSE. Both returned to sender with issues👀

Shocked with the amount of response and feedback for all you guys.
I really do appreciate all your help and advice and im going to forward your comment onto the company whom sold me the vehicle "Scottish Motor Services" who have been selling cars since the 1940's hence the reason i thought they were a trust worthy company to deal with.

I shall keep everyone up to date with my findings and return emails from the trader
