Foxy, I appreciate what Bobby is saying but I dont think thats the way forward, despite all the issues you have experienced,YOU need to demonstrate that you are willing to give LR the chance to sort things out for you (not the stealer in question) but LR via whoever they wish to use to sort your car, whilst that may well be the supplying dealer it doesnt have to be !! i.e. make sure you contact them as previously suggested , once they are aware of your issues you will be surprised at how much attention its given

give it a try because if it all goes pear shaped and you end up in court, the most important thing that any judge will look at is No1.
" has this customer given the dealer & manufacturer a reasonable opportunity to fix ?" the answer if you do it right will be "Yes" - If the answer is no all she did was park the car in front of the showroom which was an act of trying to hurt our business etc and you have refused the stealer and LR the opportunity of trying to sort the issues - you will loose because its very simple - stand back from the emotion for a moment and ask yourself at that point from the outside (court) looking in "was the customers actions reasonable ?" if they think not you will loose an opportunity to be awarded all your money back

No2. Has the dealer / manufacturer not fixed the problems ? if they have failed after a reasonable time - the answer will be No !

At that point the courts will award you the refund of the purchase price and it will be LR that will be standing over it believe me thats how it works..

Its a Stressfull time and you dont need it when you have spent so much money but you should get sorted if you get the right people at LR involved...That bit is crucial

I ended up taking a well known German Brand (lets call them WMB) to court over a new Z4 Whistle I had it for 5 months of which they had 6 attempts to stop roof leaking into the boot. Two of the attempts involved a whole new roof mechanism (i was told) but to no avail. My rejection approaches were not heard. I there fore stopped writing to the dealer and wrote to the manufacturer direct and copied in the dealer into all correspondance. I also copied in the SMMT (just for effect really) and always mentioned in correspondance that under Sale of Goods Act 1979, specifically Section 14 it details that the car I bought from them must be of satisfactory quality. I also stated that having it repaired was not my acceptance of the ability for future non rejection. In addition, pull your car from the dealer, but spell out that you are doing so to send to an independant specialist and get them to do a report on the problem. Keep the mileage as minimal as possible as this goes in your favour. In the end i was issued a refund (minus £300 in mileage offset!!) on the legal advice that as they had replaced the roof 2 times and that they had more than 3 chances to fix a single fault (an un written number set in precedent i think judges tend to use if goes to court) the concluded the dealer had no where else to go and to now they were effectively repairing items that were not even present when the car was built (i.e the new roof).

Sorry for the waffle, mainly reside on the d3 forum now but was just casting my eye on here again and thought i would offer my view

Morning Boys!

Well, im so sorry that I seem to have distanced myself from the site, However you know what its like when you down about something?

So I am without prejudice going to inform my friends about what the dealership have said to me in an email. BY the way is an email submissable in a UK court? My lawyer laughed when I asked this and looked at me with an eerie "dont you worry" look. I guess that this is the easiest way to make a comment to friends. After all. Its nothing that I wouldnt have said if I was to ring you all.

They very kindly wrote to me and told me to not use any of their dealerships, Which is 3 of them in total. This would be for new car sales and AFTER sales. They obviously have forgotten that before i received this email, I had made them aware of the fact it was still broken. SO now they have broken their sales contract and turning down warranty work on my car. Interesting I hear you say. They also said that they didnt want me to speak to anyone their either.....
HAVE I BEEN GIVEN A DEALERSHIP ASBO.? Pmsl ....... Rolling with laughter

I am outraged as to have been treated like this. I would of course like to name the dealership, however my lawyer says its best not directly, but most of you know who I got my car from anyway.

I will update as and when I can.

quite laughable in terms of customer service, out of interest at what level was the person who pen'd the email ?

This will simply strengthen your case against them, what I don't get is why an dealer cares about pushing on behalf of a customer to hand a car back as not fit for purpose, surely its not them who carry the burden rather the manufacturer.

As in the case of my friend with vw - the dealer and manufacturer work together as neither want to lose money and they don't consider losing a customer or future sales as a problem - plenty more fish in the sea Evil or Very Mad

The law needs to make it easier for consumers - all the hype from the government and it is now harder to get recourse than ever. Companies are to big and get away with it Big Cry

Incidentally have you tried consumer direct and if you used finance you may be better claiming against finance company Thumbs Up

I totally feel your pain Foxy. I am myself going through a battle after the accident. If you need any kind of help, or you just want to talk please let us/me know. The support you can get on this website, when the times are tough, is amazing.
