i rang my bank as i paid by switch/maestro but they said they could return the funds and told me to speak to a financial ombudsman, so gutted Living the dream!

you wont lose a penny. Dealers rarely have a leg to stand on when it comes to deposit, unless you are ordering a brand new car and even then only if it is being customised. For a used vehicle, there is ZERO chance they can keep your money - just mention Trading Standards and it will magically appear, I guarantee |

You will get it back - there's not a dealer in the land that could get away with keeping a security deposit, least of all for a used car
