Gutted - Got done by unmarked car doing 60mph on a 40....

Folks

Was caught last night doing 60 in a 40 - it's the new link road called A63 coming out of Leeds - nice wide dual carriageway, no pedestrians, no toher traffic (other than the PC!) good lighting, full view of road ahead.....However received a fixed penalty notice from so looking forward to my insurance going up next time I renew.

Anyone got any advice? Are there any justifiable reasons for challenging it?

I am not proud of speeding but really this is a wide dual carriageway with very little traffic in good light - come on - help me out!!

England 

some speed limits are ridiculous, i'm all for them in residential and school areas but we have a dual carriage way near us at 30 mph, barriers either side no pedestrians. its ridiculous

Sure you know this, but tell the insurance company now as well, not just at renewal. Just in case you have an accident in the meantime they may refuse cover if you didnt disclose

Get the feeling that in this economic climate they would use any get out clause!!

I'm not being funny (especially with my very own 6 points Whistle ) but why would you expect to challenge it when caught doing 60 in a 40? Confused

The only way you will get away with this is if the police dont follow the rules.
I'm a bit rusty on the law Rolling Eyes - but you could ask for the photo for proof of who was driving. If they fail to provide it you are in the clear. However, to be honest, its only 3 points and a £60 fine, your insurance premium may not change.. I suspect if it was an unmarked car then they actually stopped Jonathon and served him with a ticket.....thus you challenge at the time or you are shafted....well pretty much.
What speed detection device did they you to work out your speed mate?
If by using the cars calibrated speedo was the cop on their own or double crewed?
If they used VASCAR - average distance/speed calculation you could always ask when the vehicle was last calibrated and has the car had any new front tyres fitted since the last calibration?

Bit of clutching at straws I'm afraid......you won't like me saying this but if you can't spot an unmarked car then perhaps you should stick to the speed limits.

Actually, not true.

Years ago, I was stopped by a marked car, which I unfortunately had undertaken at a very high speed.
The vascar reading was luckily at 95 MPH.
I was served with a ticket, and i nominated a Scottish police station to provide my license/insurance.
As I was stopped in England, as soon as the police officer wrote the name of the Scottish station on the ticket, the ticket became void. (According to the Road Traffic act, for offenses in England, the producer must be an English police station)...
I was given a court summons, which was thrown out and all costs were refunded.

I was actually reffering to the point of asking for a photo to prove who the driver was (see quote).
You always have the choice to take a fixed penalty notice to court at any point, somethimes you are lucky....sometimes not.
A mate of mine at work (an expert) took one to court and was found guilty..... they took his pants down and spanked him good and propper, cost him best part of £500 once court costs were included and he still got the points on top!

Most insurance companies don't take any notice of three points on someones licence. So many people now carry three points it is classed as "the norm". Arctic Frost TDV6 SE. I think you've all got me sussed - if I can't spot an unmarked police car on an open road then I should stick to the speed limits!

I guess I have just been lucky for 23 years - I'll take the points and some humble pie!
