Personally wouldnt risk it but whats to say if you had a "second hand car" it was in fact you that stained the whatchameboba with red diesel? Surely on a multi owner car its impossible to say for sure who is guilty as long as it has white diesel in at the time of being busted!
Doesn't the test detect amounts of red diesel i.e. in ppm, so they could effectively judge how long it's been since red diesel was used? Line that back up with the DVLA record for the car and they can tell if it was you or the previous owner who used it. Not sure if that would be accurate enough to stand up in court as it were though

just like to clear one misconception up. Red Diesel does NOT stain the interior of an engine or diesel tank. It will stain a fuel filter only, once the tank is empty and the fuel lines flushed through and filter changed there will be no difference pre or post red diesel.
And I do know through legitimate means - we run several farm based tractors and diggers.
One other thing, unless you can afford huge fines, don't mind a jail term and your vehicle being confiscated and crushed DON'T risk it - they will get you!!!!!!!!!!!!!!!!!!!!!!!!! one way or another
