Not guilty??? But hey you can still pay up!

You are now liable to pay full Court Costs in defending any motoring offence even if you are found not guilty!!

When it comes to motoring offences, in reality it is very very very rare that someone is "not guilty", it is generally more the case that they "got away with it", but still......

however if I was caught doing 120mph say and was found "not guilty", I wouldn't be kicking up a fuss about court costs.

But I do see your point

I was surprised to find out 1in 4 cases results in a not guilty verdict.

25% is a lot bigger margin than I imagined.

Was it on this site the Oxford Bus Lane saga where when it was challenged in court it was found to be illegal as the the right bye law or and signs were not used. Quite a few incidents of people challenging yellow lines have been found correct as well, because councils just paited the lines but did not pass the laws.

Thinking the goverment by implementing this will find people less incentivised to look into their own bungling and incompetance and make the figures look better at the same time as lining their corperate coffers for more bungling work to be carried out Twisted Evil

Remember in motoring law you are guilty until you prove your innocence, it still costs you time and effort to do this, why should you pay even more.

We have also got to be saving our pennies to pay for any pedestrian or cyclist that comes into contact with our vechicle because that law is being changed to so you will always be guilty, whatever.

Having had a pedestrian in coventry try to commit suicide by jumping in front of my lorry some years back, was luckly well witnessed by others and apart from having to deal with the screams and bloody mess that reulted in the incident, why would I wish to now have to pay for that and be guilty with out any form of appeal Twisted Evil

Funnily enough I was thinking the same thing when I picked up a property brochure or 2 for Menorca when i was over last week for a break. Only prob is they drive on the wrong side for my RRS...... Yep was me !

Last I heard Oxford CC were still fighing the ruling.

The last 5 tickets I received have all been overturned either on appeal or by the ticket office involved !

5 sounds like quite a few however its over a 4 year period and looks something like this;

Parking fine - wrong road entered on ticket !

Parking fine - ticket given even though pay and display on dashboard.

Speeding 43 in 30 - Picture taken was of a car overtaking in the same road as me but ticket / evidence showed picture of my number plate !

Red light - Faulty camera, ticket dropped after the Ticket Office realised.

If you receive a fixed penalty notice its worth checking very carefully. I would suggest in a high number of cases mistakes are made and a letter to the Ticket Office could result in the ticket being cancelled.
