A matter of opinion of course, but maybe he/she considered they could stop within the distance they could see a vehicle in front that also was without foglights on? Foglights used without dense fogs destroys the warning thst brake lights give to following vehicles.

As I said, a matter of opinion and judgement - obviously different to your own.
